Can I gift my property to my brother?

Question

I own a property outright in my name.  I would like to gift this to my brother. 

I am married under Shariah (Muslim law) but never had the marriage acknowledged/ceremony in the UK.  My husband lives with me but has only been in the UK for 4 yrs and has not yet naturalised.

 

Can I gift my property in my name over to my brother without my husband's knowledge as I bought and paid for the property?

If you gift the property to your brother you will be deemed to have disposed of it at its market value for CGT purposes. I cannot advise on the question of giving without your husband's knowledge - this is not a tax question.
